Terms of use
The agreement between you and Michael Kutcher when you use this website.
Effective 3 September 2026 · Version 1.0
Please read these terms. By accessing or using michaelkutcher.com you agree to them. If you do not agree, please do not use the site.
1. The site
This website is operated by Michael Kutcher. It exists to describe his speaking work, publish his writing, and let event professionals make contact. It is informational.
2. Permitted use
You may read, quote briefly with attribution, link to, and share this site's pages for personal or professional purposes. You may not:
- Copy, republish or redistribute substantial portions of the content as your own.
- Use any content to train, fine-tune or evaluate a machine learning model, or to build a competing or derivative service, without written permission.
- Scrape, harvest or systematically extract content or contact details.
- Misrepresent your relationship with Michael Kutcher, or imply endorsement, sponsorship or affiliation that does not exist.
- Interfere with the operation or security of the site, or attempt to gain unauthorised access to any part of it.
3. Intellectual property
All content on this site, including text, essays, photographs, design, layout and code, is owned by Michael Kutcher or used with permission, and is protected by United States and international copyright law.
His writing
The essays published here are Michael's own work. You may quote a short passage with clear attribution and a link. Reproducing a whole piece requires written permission.
Photography
Photographs of Michael, including the family and childhood photographs on the About page, are used with his permission and are not licensed for reuse, alteration or redistribution. They are personal images published for the purpose of telling his story on this site and no other. Approved press images and the terms on which they may be used are in the media kit.
Trademarks
Diffability True™ is a trademark of Michael Kutcher. It should be written in full whenever the framework is named, and it may not be used to describe another person's program, product or methodology.
4. Third-party marks and attribution
The Media page cites publications, broadcasters, institutions and podcasts that have covered or hosted Michael. Those names, mastheads and logos are the trademarks of their respective owners and appear here solely for identification, citation and reference, which is nominative fair use. Their appearance does not indicate endorsement, sponsorship, affiliation or any commercial relationship.
Every entry links to the original so it can be verified at source. That index was compiled on 3 September 2026 and is updated as coverage appears. If you own one of these marks and want a citation amended or removed, write to stephanie@taspeakersmanagement.com and it will be actioned promptly.
5. Copyright complaints
If you believe material on this site infringes your copyright, send a notice under the Digital Millennium Copyright Act to stephanie@taspeakersmanagement.com, including identification of the work, the location of the material, your contact details, a statement of good-faith belief, and a statement made under penalty of perjury that you are authorised to act. Valid notices are actioned and the material removed or disabled.
6. Booking is not formed here
Nothing on this site is an offer, a quotation or a contract. Submitting an inquiry does not reserve a date, create an obligation on Michael Kutcher to speak, or bind either party. Speaking engagements are confirmed only in a signed written agreement arranged through TA Speakers Management, and the terms of that agreement govern the engagement and prevail over anything on this site.
7. No professional advice
Michael's keynotes and writing address perspective, resilience, disability and lived experience of serious illness and organ transplantation. None of it is medical, psychological, legal or financial advice, and none of it creates a professional relationship of any kind. It is his personal experience and his reflection on it. Do not rely on anything here in place of advice from a qualified professional, and never disregard or delay seeking medical advice because of something you read on this site.
8. Accuracy and availability
Reasonable care is taken to keep this site accurate and current, but dates, availability, coverage and other details can change. Confirm anything you intend to rely on. The site may be unavailable, changed or withdrawn at any time without notice.
9. Third-party sites
Links to booksellers, publishers, publications and partner organizations are provided for convenience. Those sites are not controlled here, their content is not endorsed by their appearance, and no responsibility is accepted for them or for any transaction you enter into with them.
10. Disclaimer of warranties
To the fullest extent permitted by law, this site and its content are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement. No warranty is given that the site will be uninterrupted, secure, error free, or free of harmful components.
11. Limitation of liability
To the fullest extent permitted by law, Michael Kutcher and TA Speakers Management will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of or inability to use this site, whether based in contract, tort, negligence, strict liability or any other theory, and whether or not advised of the possibility of such damages.
To the fullest extent permitted by law, total aggregate liability arising out of or relating to this site will not exceed one hundred United States dollars (USD 100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
12. Indemnity
You agree to indemnify and hold harmless Michael Kutcher and TA Speakers Management from any claim, demand, loss, liability or expense, including reasonable legal fees, arising out of your use of this site, your breach of these terms, or your violation of any law or the rights of a third party.
13. Privacy
Use of this site is also governed by the privacy policy, which forms part of these terms.
14. Accessibility
This site is built to meet WCAG 2.2 Level AA, and accessibility is treated as a requirement rather than an enhancement. If you encounter a barrier, report it to stephanie@taspeakersmanagement.com and it will be addressed. Where a fix takes time, an alternative means of access will be offered.
15. Changes to these terms
These terms may be updated. The effective date and version at the top of the page will change, and continued use after an update means you accept the revised terms.
16. Governing law and disputes
Before launch: confirm the governing law, the venue for disputes, and whether to require binding individual arbitration with a class-action waiver. Michael is in Colorado and his representation is Canadian, and these clauses bind him as well as the reader, so they are his decision and his lawyer's, not a default this build should pick.
17. Severability and entire agreement
If any provision of these terms is held unenforceable, the remainder stays in force. These terms, together with the privacy policy, are the entire agreement between you and Michael Kutcher regarding this website. A failure to enforce a provision is not a waiver of it.
18. Contact
